This Privacy Policy (“Privacy Policy”) explains our privacy practices for the activities described herein. Please read this Privacy Policy carefully to learn how we collect, use, share, and otherwise process information relating to individuals (“Personal Data”), and to learn about your rights and choices regarding your Personal Data.

1. Responsible Entity

Stratify is the controller of your Personal Data as described in this Privacy Policy, unless specified otherwise.

This Privacy Policy does not apply to the extent we process Personal Data in the role of a processor or service provider on behalf of our customers, including where we offer to our customers various software products, platforms, and services through which our customers (or their affiliates) collect, use, share, or otherwise process Personal Data.

For detailed privacy information related to a Stratify customer or a customer affiliate who uses the Stratify software products, platforms, and services as the controller, please contact that customer directly. We are not responsible for the privacy or data security practices of our customers, which may differ from those explained in this Privacy Policy.

2. Processing Activities Covered

This Privacy Policy applies to the processing of Personal Data collected by us when you:

  • Visit our websites that display or link to this Privacy Policy (including stratifymlp.com);

  • Visit our branded social media pages;

  • Receive communications from us, including emails, phone calls, or texts;

  • Use our software products, platforms, and services as an authorized user where we act as a controller of your Personal Data; or

  • Apply for employment opportunities with us.

Our websites, platforms, and services may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and we do not accept any responsibility or liability for these policies. Please check these policies before you submit any data to these websites.

The Personal Data we collect from you may include identifiers, geolocation data, professional or employment-related information, visual information, internet activity information, and inferences drawn from any of these categories. We collect such information in the following situations:

Automatic Website Interactions: If you interact with our websites or emails, we automatically collect information about your device and your usage of our websites or emails (such as IP addresses or other identifiers) using cookies, web beacons, or similar technologies (see Section 4 for more details).

  3. Service Usage: If you use and interact with our services, we automatically collect information about your device and your usage of our services through log files and other technologies (see Section 4).

  4. Communication Records: If you communicate with us (for example, via a phone call that we initiate), we may record that call in accordance with applicable law.

  5. Voluntary Submissions: If you voluntarily submit certain information to our services—such as by completing online forms or surveys—we collect the information you provide as part of that request.

4. What Device and Usage Data Do We Process?

4.3 Do-Not-Track Signals

​

“Do Not Track” (DNT) is a privacy preference that users can set in certain browsers. Because there is no accepted industry standard on how to respond to DNT signals, we do not respond to them at this time.

5. Purposes for Which We Process Personal Data

We collect and process your Personal Data for the following purposes:

  1. Providing our websites, platforms, and services: We process your Personal Data to perform our contract with you for the use of our websites, platforms, and services, and to fulfill obligations under applicable terms of use or service.

  2. Promoting the security of our websites and services: We track use of our websites and services, create aggregated non-personal data, verify accounts and activity, investigate suspicious activity, and enforce our terms and policies as necessary to safeguard our systems and applications.

  3. Managing user registrations: If you have registered for an account with us, we process your Personal Data by managing your user account to perform our contract with you in accordance with our terms.

  4. Handling contact and user support requests: If you fill out a web form, request user support, or contact us by other means (including phone), we process your Personal Data to communicate with you and fulfill your request.

  5. Developing and improving our websites and services: We analyze trends and usage of our websites and services to improve functionality, user experience, and overall performance.

  6. Assessing and improving user experience: We process device and usage data to analyze trends and assess/improve the user experience and the services we offer.

  7. Identifying customer opportunities: We evaluate new potential customer opportunities to ensure our products and services meet user demands.

  8. Recording phone calls: We may record phone calls (where lawful) for training, quality assurance, and administration purposes. If required by law, we will obtain your consent or provide the option to object before recording.

  9. Complying with legal obligations: We process your Personal Data to cooperate with public and government authorities, courts, or regulators in accordance with our legal obligations (e.g., responding to lawful requests and court orders).

6. Who Do We Share Personal Data With?

Any Personal Data that you provide to us may be accessed, shared, or processed by our offices in the United States and/or service providers located in the United States. This may involve the transfer of your Personal Data across international borders. The data protection standards in the United States may differ from—and be lower than—those enforced in your jurisdiction.

Where required by applicable law, we maintain appropriate safeguards (e.g., Standard Contractual Clauses) to ensure the lawful transfer of Personal Data. To request a copy of these safeguards, please contact us as set forth in the Contact Us section below.

8. Children

Our websites and services are not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information, please contact us using the details provided in the Contact Us section below. If we learn that a child under 13 has provided us with personal information, we will take steps to delete such information.

9. How Long Do We Keep Your Personal Data?

We retain your Personal Data for a period consistent with the original purpose of collection (see Section 5) or as necessary to comply with our legal obligations. When determining retention periods, we consider:

  • The amount, nature, and sensitivity of the Personal Data;

  • The potential risk of harm from unauthorized use or disclosure;

  • The purposes for which we process the data and whether we can achieve those purposes by other means;

  • Applicable legal requirements and relevant statutes of limitation.

After the applicable retention period has ended, we will securely delete or anonymize your Personal Data. If complete deletion is not technically possible, we will take reasonable steps to prevent any further use of or access to such data.

  • Know whether (and how) we disclose or sell Personal Data

  • Request the deletion of Personal Data in certain circumstances

  • Opt out of the sale of Personal Data

  • Not be discriminated against for exercising these rights

We do not “sell” your Personal Data as defined by applicable state laws. If you have additional questions or requests, please see Section 10.4.

10.3 Additional Disclosures for Data Subjects in the EEA and the U.K.

If you are located in the European Economic Area (EEA) or the United Kingdom, our legal bases for collecting and using your Personal Data include:

  • Performance of a contract: e.g., providing our services or customer support.

  • Legitimate interests: e.g., fraud prevention, security of our network and services, improving our products.

  • Legal obligations: e.g., recordkeeping and responding to lawful requests.

  • Consent: where required by law (you can withdraw consent at any time).

You may also have the right to lodge a complaint with your local data protection authority. However, we encourage you to contact us first so we can address your concerns.

10.5 Your Rights Relating to Customer Data

​

As noted above, we may process Personal Data submitted by or for a customer to our software products, platforms, and services in the role of a processor on behalf of our customer (who is the controller). We are not responsible for—and have no control over—the privacy and data security practices of our customers, which may differ from those explained in this Privacy Policy.

If your data has been submitted to us by or on behalf of a Stratify customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with the relevant customer directly. If you contact us about customer-submitted data, please provide the name of the Stratify customer who submitted your data to us. We will refer your request to them and assist them in responding to your request in a reasonable timeframe.

11. How We Secure Your Personal Data

​

We implement various security measures to protect your Personal Data, including (where feasible):

  • Encryption during data transfer and storage

  • Access controls to limit who can access your data

  • Confidentiality commitments from our employees and service providers

However, no website or application can guarantee complete security. While we take reasonable measures to protect the confidentiality, security, and integrity of Personal Data, transmission of data over the internet always carries some risk.
